Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") form a binding agreement between you and Cosimo Orlacchio (VAT / Tax code IT01836370625) ("GP Clash", "we", "us") and govern your use of the GP Clash mobile application and website (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility & age

You must be at least 14 years old to create an account and use the Service. If you are below the age of majority in your country, you must have your parent or guardian’s consent. By using the Service you represent that you meet these requirements.

3. Accounts & registration

You are responsible for providing accurate information, for keeping your login credentials confidential, and for all activity that occurs under your account. You must notify us promptly of any unauthorised use. We may refuse, suspend, or reclaim accounts that violate these Terms.

4. License to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable license to use the Service for your own non-commercial entertainment. You may not copy, modify, distribute, reverse engineer, or create derivative works from the Service except as permitted by law.

5. Acceptable use

You agree not to:

• Cheat, exploit bugs, or otherwise interfere with fair play.
• Use bots, scripts, scraping, or other automated means to access or manipulate the Service.
• Create multiple accounts to gain an unfair advantage, or share or sell accounts.
• Harass, abuse, or harm other users.
• Attempt to gain unauthorised access to the Service, other accounts, or our systems.
• Use the Service for any unlawful purpose or in violation of these Terms.

6. Purchases, subscriptions & virtual items

GP Clash is free to download and play. We may offer optional in-app purchases and subscriptions, which are processed by the Apple App Store and Google Play Store under their respective terms; the price and contents of each purchase are shown in the app before you confirm.

Any in-game currency, credits, budgets, or rewards are virtual items licensed to you for use within the Service. They have no monetary value, cannot be exchanged for real money or cashed out, and are not a form of betting, wagering, or gambling.

Refunds, cancellations, and subscription renewals are governed by the policies of the App Store / Google Play and by applicable EU and Italian consumer law, including any statutory right of withdrawal. Paid subscriptions renew automatically for the same period at the then-current price shown in the app, unless you cancel at least 24 hours before the end of the current period; any unused portion of a free trial is forfeited when a paid subscription begins. You can view, manage, or cancel a subscription at any time in your App Store or Google Play account settings — deleting the app alone does not cancel a subscription.

7. Fantasy gameplay & fair play

The Service includes leagues, live auctions, line-ups, duels, and leaderboards. Game rules, scoring, and features may change as we develop and balance the game. We may correct scoring errors, reverse the results of bugs or abuse, and take reasonable measures to preserve fair and competitive play.

8. User content

You may provide content such as a display name, league names, and support messages ("User Content"). You are responsible for your User Content and must ensure it is lawful and not infringing or offensive. You grant us a non-exclusive, worldwide, royalty-free license to host and use your User Content solely to operate and provide the Service.

9. Intellectual property

The Service, including its software, design, branding, and content (excluding User Content), is owned by GP Clash or its licensors and is protected by intellectual property laws. These Terms grant you no rights in our intellectual property other than the limited license set out above.

10. No affiliation with Formula 1 or the FIA

GP Clash is an independent fantasy game and is not affiliated with, endorsed by, or sponsored by Formula 1, the FIA, or any team, driver, or official body. All related names, logos, and trademarks are the property of their respective owners and are used for identification purposes only.

11. Third-party services

Your use of the Service may also be subject to the terms of third parties, including the Apple App Store and Google Play through which you download the app, and infrastructure providers such as DigitalOcean (EU hosting and object storage) and Google (Firebase). Those terms govern their respective parts of the experience.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that live race data and scores will always be accurate or timely.

13. Limitation of liability

To the maximum extent permitted by law, GP Clash shall not be liable for any indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill, arising from your use of the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable Italian or EU consumer protection law.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if necessary to protect the Service or other users. Upon termination, the licenses granted to you end and certain provisions of these Terms survive.

15. Governing law & jurisdiction

These Terms are governed by Italian law and, where applicable, EU law. Disputes shall be subject to the exclusive jurisdiction of the courts of Benevento, Italy, without prejudice to any mandatory consumer rights that allow you to bring proceedings in your country of residence.

16. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will update the "last updated" date above and, where appropriate, notify you through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
